1. PLATFORM ROLE, LEGAL STATUS & BUSINESS CLASSIFICATION
1.1 Platform Role Definition
Safe & Sound Home Services Inc. (“Safe & Sound”) operates a digital platform providing:
- Advertising services
- Digital publishing and promotional exposure
- Consumer interest registry services
- Ethical marketplace discovery mechanisms
Safe & Sound expressly does not operate as:
- A product seller
- A service provider
- A marketplace transaction processor
- A broker
- An agent
- A fiduciary
- A contracting party
- A guarantor or insurer of goods or services
All transactions, service engagements, purchases, payments, deliveries, warranties, and contractual obligations are formed solely and exclusively between independent third-party vendors and end consumers.
1.2 Legal Classification
Safe & Sound is legally structured and positioned as:
- An advertising platform
- A digital publishing medium
- A consumer advocacy and registry service
Safe & Sound does not facilitate transactions, negotiate contracts, collect transaction funds, or participate in contractual performance.
2. LIMITATION OF LIABILITY & DISCLAIMER OF PLATFORM RESPONSIBILITY
2.1 No Transactional Liability
Safe & Sound does not:
- Process payments
- Handle funds
- Provide escrow services
- Facilitate contract formation
- Participate in negotiations
- Guarantee performance
- Supervise service execution
2.2 No Warranties
Safe & Sound disclaims all express and implied warranties including, without limitation:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy
- Completeness
- Safety
- Timeliness
2.3 Maximum Liability Limitation
To the fullest extent permitted under applicable law, Safe & Sound’s aggregate liability shall not exceed the total fees paid by a vendor to Safe & Sound in the prior ninety (90) days, or $100 CAD/USD, whichever is greater.
